The fundamental character of a punishment is the subject of this paper. Based on the assumed function of a punishment (deterrent), a punishment has to be perceived and experienced to be an adverse result by the punished and the public. The first factor in particular means that the courts have to have flexibility to sentence a person to such a punishment that is experienced as such. The legal question becomes how this customization of a punishment is acceptable from an equality (...) standpoint. In the field of environmental protection, the administrative process poses serious problems. Philosophical discussions on causal inference in medicine are stuck in dyadic camps, each defending one kind of evidence or method rather than another as best support for causal hypotheses. Whereas Evidence Based Medicine advocates the use of Randomised Controlled Trials and systematic reviews of RCTs as gold standard, philosophers of science emphasise the importance of mechanisms and their distinctive informational contribution to causal inference and assessment. Some have suggested the adoption of a pluralistic approach to causal inference, and an inductive (...) rather than hypothetico-deductive inferential paradigm. However, these proposals deliver no clear guidelines about how such plurality of evidence sources should jointly justify hypotheses of causal associations. We here develop such guidelines by first giving a philosophical analysis of the underpinnings of Hill’s viewpoints on causality. We then put forward an evidence-amalgamation framework adopting a Bayesian net approach to model causal inference in pharmacology for the assessment of harms. Our framework accommodates a number of intuitions already expressed in the literature concerning the EBM vs. pluralist debate on causal inference, evidence hierarchies, causal holism, relevance, and reliability. In this essay, we aim to provide an overview of the periodic table’s origins and history, and of the elements which conspired to make it chemistry’s most recognisable icon. We pay attention to Mendeleev’s role in the development of a system for organising the elements and chemical knowledge while facilitating the teaching of chemistry. We look at how the reception of the table in different chemical communities was dependent on the local scientific, cultural and political context, but argue that its (...) eventual universal acceptance is due to its unique ability to accommodate possessed knowledge while enabling novel predictions. Furthermore, we argue that its capacity to unify apparently disconnected phenomena under a simple framework facilitates our understanding of periodicity, making the table an icon of aesthetic value, and an object of philosophical inquiry. Finally, we briefly explore the table’s iconicity throughout its representations in pop art and science fiction. (shrink)

The chemist Max von Pettenkofer studied with Justus von Liebig, and after leaving Giessen in 1844 did not immediately find an academic position. During the period 1844/1845 he wrote a cycle of 16 Chemical Sonnets, but published them only in 1886. The Sonnets have with few exceptions a historiographical character. We present a translation of the Sonette into Portuguese as well as commentaries about their content and their philosophical significance. We also comment rather briefly on Pettenkofer’s career as an empirical (...) chemist and later as a somewhat heterodox hygienist. (shrink)

This paper presents the contributions of Alcindo Flores Cabral, professor of Chemistry at the Faculdade de Agronomia Eliseu Maciel, nowadays part of the Universidade Federal de Pelotas, to chemistry teaching. It is a contribution almost unknown to the Brazilian chemical community, although recognized as valuable by several renowned chemists abroad, like W. Hückel, G. Charlot, F. Strong, E. Fessenden and others. Cabral’s innovative helical representation is presented in connection not only with contemporary representations, but also an incursion is made into (...) the first helical systems proposed, those of Hinrichs and of Baumhauer. The choice of new technology in a resource-based industry has far-reaching implications for its ethical performance. The kraft pulping industry uses considerable amounts of wood as raw material, and regulatory agencies have been tightening their control limits for effluent, solid waste and air emissions. The technological solutions required to reduce the environmental impact of the industry are shown to have the potential of causing social hardship for the mill's employees, the affected communities, lenders, and owners. In some instances, the technological (...) solutions give rise to new environmental challenges. Forestry practices are influencing the public's perception of the kraft pulping industry, its ethical and environmental performance, its profitability, and the properties of its product, which may increase wood requirements. New forestry practices have the potential to reduce the forest land area required to sustain the kraft pulp production at a given level but ethical problems associated with genetic manipulation, phenodiversity, and biodiversity are identified. Data from further human experiments touch four open questions in the target article. (1) Extinction of reward acquisition postulated by Depue & Collins's model could not be confirmed if correlating craving for, liking of, and satisfaction from smoking. (2) Intraindividual correspondence between responsivity to dopamine agonists and antagonists could likewise not be confirmed. (3) Nicotine craving and drug-induced hormone responses were not substantially correlated. (4) Low serotonin can be the cause and not just the moderator of dopaminergic sensitivity, and personality (...) correlates of low dopamine/low MAO (aggressive impulsive traits) can hardly be related to the positive emotion associated with dopaminergic activity. According to the Variety of Evidence Thesis items of evidence from independent lines of investigation are more confirmatory, ceteris paribus, than e.g. replications of analogous studies. This thesis is known to fail Bovens and Hartmann, Claveau. How- ever, the results obtained by the former only concern instruments whose evidence is either fully random or perfectly reliable; instead in Claveau, unreliability is modelled as deterministic bias. In both cases, the unreliable instrument delivers totally irrelevant information. We present a model which formalises (...) both reliability, and unreliability, differently. Our instruments are either reliable, but affected by random error, or they are biased but not deterministically so. Bovens and Hartmann’s results are counter-intuitive in that in their model a long series of consistent reports from the same instrument does not raise suspicion of “too-good-to- be-true” evidence. This happens precisely because they neither contemplate the role of systematic bias, nor unavoidable random error of reliable instruments. In our model the Variety of Evidence Thesis fails as well, but the area of failure is considerably smaller than for Bovens and Hartmann, Claveau and holds for realistic cases. The essential mechanism which triggers VET failure is the rate of false to true positives for the two kinds of instruments. Our emphasis is on modelling beliefs about sources of knowledge and their role in hypothesis confirmation in interaction with dimensions of evidence, such as variety and consistency. (shrink)

Both the pragmatic logic of social critique and the idea of a critical social theory presuppose the possibility of distinguishing progressive from regressive forms of social change. Thus, a condition of adequacy of social critique in general, and of critical social theory in particular, is the theoretical capacity to identify progressive social change. I begin this study by showing that, since it incorporates a theory of social evolution, Habermas's conception of critical social theory satisfies this condition. ;Habermas's theory of social (...) evolution, however, is a source of much misunderstanding in the literature. I attempt to clarify the theory with a careful reconstruction of its concepts and fundamental theses, and by systematizing the theory as a whole. The central thesis of the theory of social evolution that functions to identify progressive change is that the logic and the content of social change can be distinguished, and that we can rationally reconstruct the developmental logic of the normative structures of societies. I analyze the concept of developmental logic and defend it against some common objections, including the objection that the theory draws a false analogy between the structures of individual maturation and social rationalization. This 'ontogenetic fallacy' is not committed, I argue, because Habermas translates only the formal features of the concept of developmental logic from its genesis in psychology to social theory. ;I conclude by arguing that Habermas's theory of social evolution does entail an adequate conception of progress, but that it is insufficiently differentiated. That is, Habermas's theory explains progress in each of the dimensions of cognitive knowledge and moral insight; but it lacks an explanation of progress in the dimension of expressive self-realization. Drawing upon the conceptual resources of Habermas's theory, I show that it can account for this dimension if it also includes a notion of expressive action that is pre-discursive. (shrink)

The debate between Jurgen Habermas and Charles Taylor is reflective of the enduring conflict between liberal philosophy with its emphasis upon freedom, equality, and legal rights, and Aristotelianism with its accent upon the cultivation of virtue, personal responsibility and shared notions of the Good. Though grounded in opposite ends of the philosophical spectrum, both men remain critical of the burgeoning effects of instrumental rationality and the social atomization and anomie it continues to generate; both understand the extent to which the (...) self is a social construct and the role of interpersonal intersubjectivity in the development of their individual and collective identities; both argue for the centrality of certain goods in maintaining a minimal degree of social cohesion; and both affirm that the crucial feature of human life is communication and its dialogical character. ;To overcome the adverse manifestations of our positivistic ethos with its over-reliance upon purposive-instrumental reason, each has responded with a countervailing notion of rationality---"phronesis" or Aristotelian practical reason for Taylor and "communicative reason" for Habermas. Each's choice of reason has led to profound differences in their respective notions of the self as well as fundamental incongruities in their moral and political philosophies. In the interest of preserving the autonomy and integrity of the individual while yet affirming universal justice, Habermas argues for the formalism of a "proceduralistic" ethics. Taylor, on the other hand, advocates a "substantialist" one, a communal ethics that arises from out of people's deepest moral intuitions; an ethics bound up with historical values and ideals that stresses the cultivation of virtue and shared notions of the common good. ;I argue that although Habermas's "communicative action" with its focus upon intersubjective communication helps to bridge the competing philosophies of communitarianism and classical liberalism, a basic incommensurability still persists. However, rather than being mutually exclusive, there needs to be a creative, dialectical tension maintained between them whereby each continues to inform and influence the other. In this way, a postmodern ethics rooted in dialogue and communication can be constructed which maintains people's integrity and autonomy while similarly addressing their multiple needs and concerns, but also an ethics grounded in one's deepest moral intuitions which remains sensitive to the concrete, historical, and particularistic distinctions which differentiate their identities. Michelman's Constitutional Essentials raises important questions about the idea of political liberalism and related idea of public reason. This essay offers a sympathetic commentary while also exploring the importance of the idea of reciprocity for both Rawls and Michelman.

This paper outlines and defends a processual theory of peoplehood. On our theory, a people is, roughly speaking, composed of two things. First, an unfolding series of events coordinated by the practices of constituting, governing, or changing a polity's authoritative institutions. Second, individual persons whose lives and interests are intensely affected by these events and institutions. We call this theory deep processualism. We outline the theory by showing how it would answer five questions: the questions of constituents, individuation, origination, termination, (...) and membership: What are the chief constituents of peoples? What individuates peoples? Under what conditions do peoples originate? Under what conditions do peoples cease to be? Under what conditions is a person a member of the people? We also consider alternative theories of the nature of peoples, theories due to Juergen Habermas, Bruce Ackerman, Philip Pettit, and James Fishkin. We defend our theory on the ground that it is not embarrassed by the difficulties that we pin on these alternative theories. (shrink)

The WTO Dispute Settlement System (DSS) has been the object of many studies in politics, law, and economics focusing on institutional design problems. This paper contributes to such studies by accounting for the argumentative nature and sophisticated features of the DSS through a philosophical analysis of the procedures through which it is articulated. Jürgen Habermas's discourse theory is used as a hermeneutic device to disentangle the types of ‘orientations’ (compromise, consensus, and mutual understanding) pertaining to DSS procedures. We show (...) that these latter are oriented primarily to put the parties in a position to reach mutual understanding. Such an orientation is no mere idiosyncrasy of the DSS but is the only one consistently conducive to the WTO's general aims, in response to the various types of disputes that may arise between its Members. Will globalization promote or hinder social justice throughout the world? In this cogent analysis philosopher Kai Nielsen argues that in its present form capitalist globalization will only ensure that the rich get richer and the poor poorer. Noting that the ratio of the richest countries to the poorest has steadily grown larger under capitalism in the 20th century and that the total dollar value of the world economy has increased fivefold while the number of people living in poverty has doubled, (...) Nielsen clearly demonstrates that globalization has made and still is making a bad situation worse. While inveighing against capitalist globalization, he makes the important point that a globalization based on "market socialism" - to ensure both needed efficiency and an egalitarian conception of justice - would be a trend that people in all nations would welcome. Democratic socialism, despite historical betrayals and recent setbacks, Nielsen contends, is still humanity's best hope for achieving a classless, nonracist, and nonsexist world community. He devotes a number of chapters to a discussion of the critical theory that is the basis of this vision of a completely egalitarian international society, and he compares and contrasts his own position with that of such thinkers as Richard Rorty, John Rawls, Juergen Habermas, G. A. Cohen, and others. This well-argued critique of capitalist globalization and defense of democratic socialism as a viable alternative is essential reading for philosophers, political scientists, students of international relations, and anyone concerned about the future of democratic and egalitarian ideals. For some time now a number of critics have argued that Juergen Habermas has misinterpreted Freud. The gist of this criticism is that Habermas' interpretation of psychoanalysis as `depth hermeneutics' must violate the intent of Freud's work, which is so deeply grounded in drive theory. In other words, Habermas confuses philosophical reflection with psychoanalysis. This paper takes a somewhat different focus. It examines the consequences of Habermas' interpretation of Freud for Habermas' view of the individual. It is shown that Habermas' (...) interpretation eventuates in an abstract and shadowy view of the individual. It is argued that an alternative view of psychoanalysis, object relations theory, can help locate the source of Habermas' pale view of the individual, and help correct it, without succumbing to `neo-Freudian revisionism'. Object relations theory also suggests that in order to overcome the diminution of the individual in real life it is necessary for political theory to examine seriously the role of the family. Finally, object relations theory generates an interesting criticism of so-called postmodern psychoanalysis—for example, the work of Jacques Lacan. This criticism can help us better understand the relationship between Habermas and modernism. (shrink)

Drawing on a rich digitalized corpus of early modern texts, Hans-Juergen Diller argues that the concepts expressed by the English words >passion emotion emotion passion emotion<. But there are two concepts of a concept. According to the first, the meaning of a word expressing a concept is not sharply distinguished from the complete discourse in which it figures. According to the second, meaning is more narrow. For instance, it is restricted to the explicit definition an author provides. I show that (...) Descartes provides an explicit definition of passion and emotion in purely physical, a-moral terms. So Diller's method is not apt to trace concepts in the second, more restricted sense which Descartes himself has in mind. (shrink)

How is it possible for individuals to exercise any control over a political order that is supranational and multilayered? This key question must be answered if we are to reconcile democratic principles with the requirement of global justice as well as with the cosmopolitan political institutions that play an ever-increasing role in our world. The leading answer to this question, at present, is that of Juergen Habermas and his followers: deliberative democracy. This article, however, argues that theories of deliberative democracy (...) fail to take seriously both the problems and the opportunities of large-scale societies and so cannot provide adequate conceptual foundations for deepening and globalizing democracy. In particular, the participatory requirements of Habermas’s normative theory can be met only by making assumptions about human cognitive capacities and institutional capabilities that are not remotely plausible in any pluralistic society. There is tension in the US healthcare system due to conflicting goals of maximizing the public's health and at the same time ensuring shareholder profit among the many private organizations that provide care to those in need. As a result, nurses (often the frontline workers in this mixed public/private and economized system) may experience dissonance between their professional values and the capitalistic values embodied in the healthcare system. Beyond the workplace, nurses are also committed to championing health and wellness, to (...) advocating for social justice, and driving health policy. Yet, constrained by the conflicts between neoliberal values in an economized system and the values of care that inspire many to join the healthcare profession, nurses may lose the ability to live up to their moral ideals, to champion social justice, and to improve public health outcomes. In this paper, we use the critical theory of Juergen Habermas to explore these tensions and to suggest a path forward for nurses. We suggest that by engaging in dialog with each other and the public, and working for greater inclusivity, nurses can find ways to deconstruct ideologies inherent in our current healthcare system, to consider alternatives, and liberate healthcare from the dominance of market forces. A series of experiments investigated the effect of speakers’ language, accent, and race on children’s social preferences. When presented with photographs and voice recordings of novel children, 5-year-old children chose to be friends with native speakers of their native language rather than foreign-language or foreign-accented speakers. These preferences were not exclusively due to the intelligibility of the speech, as children found the accented speech to be comprehensible, and did not make social distinctions between foreign-accented and foreign-language speakers. Finally, children chose (...) same-race children as friends when the target children were silent, but they chose other-race children with a native accent when accent was pitted against race. A control experiment provided evidence that children’s privileging of accent over race was not due to the relative familiarity of each dimension. The results, discussed in an evolutionary framework, suggest that children preferentially evaluate others along dimensions that distinguished social groups in prehistoric human societies. (shrink)

Abū al-Ḥajj¿j Yūsuf b. Muḥammad Ibn Ṭumlūs (Alhagiag Bin Thalmus, d. 620/1223) was a philosopher, physician and direct disciple of Ibn Rushd (Averroes, d. 595/1198), who lived and practiced rational sciences in Alzira and Marrakesh, a quarter of a century after the demise of his teacher. Ibn Ṭumlūs was not Ibn Rushd's only student who engaged in work on logic, but one of dozens of disciples, suggesting that the supposed simultaneous death of the latter's philosophy is "grossly exaggerated". As a (...) valuable window into the practice of logic in 13th century al-Andalus and the Maghreb, Ibn Ṭumlūs' Compendium on Logic (Al-Mukhtaṣar fī al-manṭiq) covers all the parts of "the expanded Organon", as it was known since al-F¿r¿bī (d. 339/951). Gordon Baker and I had been colleagues at St John’s for almost ten years when we resolved, in 1976, to undertake the task of writing a commentary on Wittgenstein’s Philosophical Investigations. We had been talking about Wittgenstein since 1969, and when we cooperated in writing a long critical notice on the Philosophical Grammar in 1975, we found that working together was mutually instructive, intellectually stimulating and great fun. We thought that we still had much to say about Wittgenstein’s philosophy, and (...) it seemed to us that misinterpretations of passages in the Investigations were so extensive that it would be worth trying to write a detailed analytical commentary. It is difficult to recapture the excitement of those early days in being among the first to work on the microfilms and, subsequently, on the photocopies of Wittgenstein’s Nachlass. We spent many hundreds of hours poring over the typescripts and the often only semi-legible manuscripts, fascinated and privileged to be able to try to follow the development of the thoughts of a great philosophical genius. We talked endlessly about what we had found in Wittgenstein’s manuscripts and typescripts, and debated how it should be understood. The first fruit of our labours was Wittgenstein – Understanding and Meaning. Its guiding idea was to draw attention to the manner in which Wittgenstein linked the concepts of meaning, understanding and explanation, and so to bypass the connections between meaning, truth and truth-conditions that so fascinated philosophers of the 1970s, and to abandon the red-herring of assertion-conditions and anti-realism. After a hiatus of four years, during which time we wrote a controversial book entitled Frege – Logical Excavations and a polemical book on contemporary philosophy of language – Language, Sense. Is there any link between the doctrine of logical fatalism and prime numbers? What do logic and prime numbers have in common? The book adopts truth-functional approach to examine functional properties of finite-valued Łukasiewicz logics Łn+1. Prime numbers are defined in algebraic-logical terms and represented as rooted trees. The author designs an algorithm which for every prime number n constructs a rooted tree where nodes are natural numbers and n is a root. Finite-valued logics Kn+1 are specified that they have (...) tautologies if and only if n is a prime number. It is discovered that Kn+1 have the same functional properties as Łn+1 whenever n is a prime number. Thus, Kn+1 are 'logics' of prime numbers. Amazingly, combination of logics of prime numbers led to uncovering a law of generation of classes of prime numbers. Along with characterization of prime numbers author also gives characterization, in terms of Łukasiewicz logical matrices, of powers of primes, odd numbers, and even numbers. (shrink)

Description: This scholarly work of Dr S.M.S. Chari's deals with the critical review of seventeen philosophical systems as presented in an important philosophical treatise of the thirteenth century titled Paramata-bhanga contributed by Vedanta Desika, an illustrious successor to Ramanuja, who is the chief exponent of Visistadvaita Vedanta. The main objective of Paramata-bhanga is to establish that Visistadvaita is a sound system of philosophy as compared to the several other Non-Vedic as well as Vedic schools and also Vedanta schools developed by (...) Samkara, Yadavaprakasa, Bhaskara, and other exponents of the post-Ramanuja period. The original text written in Manipravala (a mixture of Tamil and Sanskrit) language contains, besides a brief account of the fundamental doctrines of Visistadvaita. The schools covered are Carvaka, Buddhism, Jainism, Sankhya, Yoga, Vaisesika, Nyaya, Purvamimamsa, Pasupata, Sabdabrahma-vivartavada, and Advaita Vedanta. Among the extant philosophical classics, Paramata-bhanga is a unique work. Realizing the importance of the Paramata-bhanga for the comparative study of Indian philosophy, late Dr Chari tried to give a lucid exposition of this treatise in English. Bu taşımacılık türü ihracatçılara, ara malı tedariki ve tamamlanmış ürünlerin ihraç edilmesinde masrafların azalmasına ve daha fazla mal ihracı sağlaması açısından önemli katkılar sağlamaktadır. Bu olumlu katkılar ise ekonomik büyümenin artmasını sağlayabilmektedir. Türkiye’ de demiryolu taşımacılığında en başarılı gelişmeler Cumhuriyetin ilanından sonraki kalkınma yıllarında yaşanmıştır. Demiryolu taşımacılığının kullanımı, tarihsel süreçte sanayi sektörünün, ekonomik ve sosyal yapının gelişmesine katkı sağlamıştır. Bu çalışmada Türkiye için demiryolu yük taşımacılığının ekonomik büyüme (...) üzerindeki etkileri 1960-2021 dönemi için ARDL sınır testi ekonometrik tekniğiyle analiz edilmesi amaçlanmıştır. Çalışma sonucuna göre demiryolu yük taşımacılığı hem uzun hem de kısa dönemde ekonomik büyüme üzerinde pozitif etki oluşturmuştur. Buna göre uzun dönemde demiryolu yük taşımacılığındaki %1’lik artış ekonomik büyümenin %1,95 oranında artmasını sağlamıştır. Bu noktadan hareketle demiryolu sektörüne yapılması muhtemel yatırımların ekonominin büyümesine ve gelişmesine katkı sunacağı tahmin edilmektedir. (shrink)

From Ricoeur to Action engages with the thinking of the French philosopher Paul Ricoeur (1913-2005) in order to propose innovative responses to 21st-century problems actively contributing to global conflict. Ricoeur's ability to draw from a diverse field of philosophers and theologians and to provide mediation to seemingly irreconcilable views often has both explicit and implicit practical application to socio-political questions. Here an international team of leading Ricoeur scholars develop critical yet productive responses through the development of Ricoeur's thought with respect (...) to such topics as race, environmental ethics, technology, political utopia and reinterpreting religion.
